Untuk diketahui berdasarkan Peraturan Pemerintah (PP) Nomor 45 Tahun 1990 Perubahan PP Nomor 10 Tahun 1983 tentang izin perkawinan dan perceraian bagi Pegawai Negeri Sipil. Adapun sanksi yang dijatuhkan bagi PNS yang kedapatan berselingkuh telah diatur dalam dua PP tersebut antara lain, Pasal 14 PP Nomor 45 tahun 1990 yang intinya menegaskan, “PNS dilarang hidup bersama dengan wanita yang bukan istrinya atau dengan pria yang bukan suaminya sebagai suami istri tanpa ikatan perkawinan yang sah”.
Lembaran Negara Republik Indonesia tahun 1990 Nomor 61 Penjelasan PP Nomor 45 tahun 1990 tentang Izin Perkawinan dan Perceraian Bagi PNS menjelaskan maksud pasal 14 tersebut.
Adapun sangsi bagi ASN yang kedapatan melanggar aturan tersebut dalam Pasal 15 masih dalam PP yang sama ditegaskan bahwa, PNS yang melanggar salah satu atau lebih kewajiban/ketentuan pasal 14, dijatuhi salah satu hukuman disiplin berat berdasarkan PP Nomor 30 Tahun 1980 tentang Peraturan Disiplin PNS atau setelah diubah menjadi PP No.53 tahun 2010 tentang Peraturan Disiplin PNS.
Yang dimaksud hukuman berat dalam PP Nomor 53 tahun 2010 adalah berupa penurunan pangkat satu tingkat selama tiga tahun, pemindahan dalam rangka penurunan jabatan, pembebasan jabatan, dan pemberhentian.(Win’s/Red)
