BERITASATOE.COM, – PT Trans Cibubur Property yang merupakan pengembang Trans Park Cibubur digugat Rp 3,4 miliar oleh Kontraktor PT Maras Agung di Pengadilan Negeri Jakarta Selatan karena pekerjaan tidak dibayarkan. Untuk diketahui, PT Trans Cibubur Property merupakan unit usaha dari CT Corp.
Gugatan wan prestasi diajukan oleh PT Maras Agung sebagai Penggugat yang terdaftar dengan perkara perdata nomor 915/Pdt.G/2022/PN.JKT.SEL melawan PT Trans Cibubur Property sebagai Tergugat.
Dalam gugatannya, Penggugat menuntut PT Trans Cibubur Property sebagai pengembang mega proyek Trans Park Cibubur untuk membayar kekurangan pembayaran atas pekerjaan berupa pengadaan dan Pemasangan Bekisting Tower C, membayar paket pekerjaan pengecoran beton Area Apartemen dan membayar kewajiban atas biaya sewa alat dan upah pekerja dengan nilai keseluruhan sebesar Rp 3,4 miliar secara tunai dan seketika.
PT Maras Agung mendapatkan pekerjaan dari PT Trans Cibubur Property untuk mengerjakan Proyek Trans Park Cibubur yang berlokasi di Jalan Alternatif Cibubur (Transyogi) Depok, Jawa Barat untuk pekerjaan berupa Pengadaan dan Pemasangan Bekisting Tower C, area Apartemen dengan nomor kontrak atau SPK 159/TSC-Bekisting/TCP-MA/X/19 tertanggal 11 Oktober 2019 dan Addendum I No. 001/ADD/TCP-MA/V/2020 tertanggal 14 Mei 2020 senilai Rp 11.526.187.728,- (sebelas miliar lima ratus dua puluh enam juta seratus delapan puluh tujuh ribu tujuh ratus dua puluh delapan rupiah).
Setelah PT Maras Agung melakukan pekerjaannya dengan tuntas, pihak PT Trans Cibubur Property hanya melakukan pembayaran sebesar sebesar Rp. 8.580.620.681,- (delapan miliar lima ratus delapan puluh juta enam ratus dua puluh ribu enam ratus delapan puluh satu rupiah).
Bahwa dengan demikian, PT Trans Cibubur Property masih ada kekurangan pembayaran sebesar Rp 1.148.085.065,- (satu miliar seratus empat puluh delapan juta delapan puluh lima ribu enam puluh lima rupiah). Nilai ini sudah termasuk retensi 5% dan belum termasuk PPN 11%.
Alasan PT Trans Cibubur Property tidak mau membayar secara penuh atau 100% adalah adanya ketidaksesuaian bahan pengecoran kepala kolom di beberapa lantai yang dikerjakan oleh kontraktor terdahulu, sehingga kepala kolom tersebut harus dibongkar dan dicor ulang.
Hal ini menyebabkan pekerjaan yang dikerjakan oleh PT Maras Agung yang berada di atas lantai yang terdapat masalah pada kepala kolom tersebut tidak dapat dilaksanakan selama kurang lebih 5 bulan.
Selanjutnya PT Trans Cibubur Property memberikan pekerjaan kepada PT Maras Agung untuk mengerjakan Proyek Trans Park Cibubur yaitu melakukan paket pekerjaan pengecoran beton area Apartemen Trans Park Cibubur dengan nomor kontrak atau SPK 151/TSC-CorBeton/TCP-MA/X/19 tertanggal 16 Oktober 2019 dan Addendum I No.002/ADD/TCP-MA/VI/2020 tertanggal 14 Mei 2020 senilai Rp 2.244.156.783,- (dua miliar dua ratus empat puluh empat juta seratus lima puluh enam ribu tujuh ratus delapan puluh tiga rupiah).
Untuk pekerjaan pengecoran beton area Apartemen Trans Park Cibubur, berdasarkan perhitungan ulang bersama senilai Rp 1.853.031.620,- (satu miliar delapan ratus lima puluh tiga juta tiga puluh satu ribu enam ratus dua puluh rupiah), Tergugat baru melakukan pembayaran sebesar Rp. 1.646.809.103,- (satu miliar enam ratus empat puluh enam juta delapan ratus sembilan ribu seratus tiga rupiah). Nilai ini belum termasuk PPN dan belum termasuk retensi 5%.
Dengan demikian, Tergugat masih ada kekurangan pembayaran sebesar Rp 206.222.516,- (dua ratus enam juta dua ratus dua puluh dua ribu lima ratus enam belas rupiah). Nilai ini sudah termasuk retensi 5% dan belum termasuk PPN 11%.
Alasan PT Trans Cibubur Property tidak mau membayar secara penuh untuk pekerjaan pengecoran beton area Apartemen Trans Park Cibubur karena adanya kelebihan volume material bahan untuk pengecoran.
PT Trans Cibubur Property juga Tidak Membayar biaya upah pekerja dan sewa alat akibat terlambatnya proyek sebesar Rp. 2.137.222.292,- (dua miliar seratus tiga puluh tujuh juta dua ratus dua puluh dua ribu dua ratus sembilan puluh dua rupiah). Nilai ini sudah termasuk retensi 5% dan belum termasuk PPN 11%.
Keterlambatan ini bukan karena adanya sengketa antara PT Maras Agung dengan PT Trans Cibubur Property. Namun akibat sengketa antara PT Trans Cibubur Property dengan Pihak Kontraktor terdahulu sehingga terjadi keterlambatan pekerjaan selama sekitar 5(lima) bulan 8(delapan) hari.
Tentu saja alasan-alasan tersebut tidak berdasar dan beralasan karena :
- Yang memilih kontraktor pengecoran adalah PT Trans Cibubur Property;. Sementara PT Maras Agung hanya bertanggung jawab menyediakan tenaga kerja untuk melaksanakan pekerjaan pengecoran beton.
- Volume material cor dihitung dan disiapkan oleh PT Trans Cibubur Property dan PT Motive Mulia (Beton Merah Putih).
- Yang melakukan pengawasan pekerjaan pengecoran dan penghitungan volume pengecoran adalah PT Trans Cibubur Property dan PT Quanta QS Costindo.
- Pekerjaan sudah dilakukan tuntas 100% (seratus persen) secara baik dan benar sesuai dengan perjanjian kerjasama karena sudah diakui oleh PT Trans Cibubur Property melalui : Berita Acara Pemeriksaan Kemajuan Pekerjaan, Berita Acara Serah Terima Pertama (BAST I) dan Berita Acara Penyelesaian Pekerjaan 100%
Oleh karenanya, PT Maras Agung meminta kepada Majelis Hakim untuk :
- Mengabulkan gugatan Penggugat untuk seluruhnya;
- Menyatakan Perjanjian Kerja nomor 159/TSC-Bekisting/TCP-MA/X/19 tertanggal 11 Oktober 2019 dan Addendum I No.001/ADD/TCP-MA/V/2020 tertanggal 14 Mei 2020 serta SPK nomor 151/TSC-CorBeton/TCP-MA/X/19 tertanggal 16 Oktober 2019 dan Addendum I No.002/ADD/TCP-MA/VI/2020 tertanggal 14 Mei 2020 antara Penggugat dengan Tergugat adalah sah, berharga dan berkekuatan hukum;
- Menyatakan Tergugat telah melakukan perbuatan wan prestasi;
- Menghukum Tergugat untuk membayar kewajiban kepada Penggugat secara tunai dan seketika sebesar Rp 1.354.307.581,- (satu miliar tiga ratus lima puluh empat juta tiga ratus tujuh ribu lima ratus delapan satu rupiah) yang terdiri dari :
- Kekurangan pembayaran atas pekerjaan berupa pengadaan dan Pemasangan Bekisting Tower C dengan nomor kontrak atau SPK 159/TSC-Bekisting/TCP-MA/X/19 tertanggal 11 Oktober 2019 dan Addendum I No.001/ADD/TCP-MA/V/2020 tertanggal 14 Mei 2020 sebesar Rp 1.148.085.065,- (satu miliar seratus empat puluh delapan juta delapan puluh lima ribu enam puluh lima rupiah).
- Kekurangan pembayaran atas pekerjaan berupa Paket Pekerjaan Pengecoran Beton Area Apartemen Proyek Trans Park Cibubur dengan nomor kontrak atau SPK 151/TSC-CorBeton/TCP-MA/X/19 tertanggal 16 Oktober 2019 dan Addendum I No.002/ADD/TCP-MA/VI/2020 tertanggal 14 Mei 2020 sebesar Rp 206.222.516,- (dua ratus enam juta dua ratus dua puluh dua ribu lima ratus enam belas rupiah).
- Menghukum Tergugat untuk membayar kewajiban hutangnya kepada Penggugat untuk biaya sewa alat dan upah pekerja sebesar Rp. 2.137.222.292,- (dua miliar seratus tiga puluh tujuh juta dua ratus dua puluh dua ribu dua ratus sembilan puluh dua rupiah) secara tunai dan seketika;
- Menyatakan putusan ini dapat dilaksanakan terlebih dahulu meskipun Tergugat mengajukan upaya banding atau upaya hukum lainnya (uitvoerbaar bij voorraad);
Odie menyebutkan, keterlambatan ini sama sekali tidak ada kaitannya dengan sengketa antara penggugat dan tergugat, namun lantaran tergugat dengan pihak kontraktor terdahulu bersengketa, sehingga ada keterlambatan pengerjaan lebih dari 5 bulan.
“Kami minta majelis hakim mengabulkan permohonan kami. Perjanjian kontrak kerja kami jelas sah, berharga, dan berkekuatan hukum. Kami juga menyatakan tergugat telah melakukan wan prestasi,” kata Odie.
Odie menambahkan, penggugat menghukum tergugat membayar kewajiban senilai Rp1,3 miliar untuk pengerjaan proyek pengadaan dan pemasangan bekisting Tower C apartemen, serta menambal kekurangan pembayaran atas pekerjaan berupa Paket Pekerjaan Pengecoran Beton area apartemen .
“Kami juga menuntut tergugat membayar hutang upah pekerja dan sewa alat senilai Rp2,1 miliar,” tandasnya. If I have writer’s block, I occasionally just create random words, and hopefully some idea will come from that. Take a pencil, or an empty Word document and just begin typing or composing words. Some thing is bound to hit you eventually. I used to just do these exercises where I did nothing but create random sentences without using punctuation. This helped my brain juices to flow, and it allowed me to create some short poems and short, short stories. Occasionally that rare moment when two words fit together perfectly to give you a great concept for a story occurs, and who knows? Maybe those two words can launch a series of books, or a series of plays, or the great American novel.
